ALBANY, N.Y. - In a case that could affect passengers delayed on planes at airports nationwide, an industry trade group is challenging New York's law requiring airlines to provide food, water, clean toilets and fresh air to passengers stuck on the ground for more than three hours.

New York lawmakers passed the "airline passenger bill of rights" — the first law of its kind in the nation — after a series of delays last winter at John F. Kennedy International Airport that left some passengers stranded for more than 10 hours with no food or water, overflowing toilets and no air conditioning.

Industry lawyers told a federal judge Tuesday that their challenge isn't about not wanting to provide for delayed passengers.

"The only question in this case is whether the state of New York can tell airlines what to provide," said Robert Span, an attorney for the Air Transport Association.

The industry group is trying to stop the law from taking effect on Jan. 1, arguing that only the federal government can regulate airline services.

State legislators and passenger rights advocates said they pushed for the law because federal regulators have long failed to address what they say has become a chronic problem, particularly at New York airports.

"I would love for Washington to step forward, set a standard for the whole country and take care of business once and for all," said Michael Gianaris, a Queens Democrat who sponsored the legislation in the state Assembly. "They didn't do it. We had to step forward as the state which is dealing with the greatest delays in the country."

A recent federal report showed that about 24 percent of flights nationally arrived late in the first 10 months of the year, which was the industry's second-worst performance record since comparable data began being collected in 1995.

JFK had the third-worst on-time arrival record of any major U.S. airport through October, behind the New York area's other two major airports, LaGuardia and Newark, according to the report.

In a court hearing Tuesday, airline industry association lawyers said they're worried that if New York's law is upheld, other states will follow with their own laws, which would result in a confusing patchwork of state regulations.

Paul Hudson, an attorney with the nonprofit Aviation Consumer Action Project who appeared in court alongside a lawyer from the state attorney general's office, said other states likely would pass similar laws.

"Other states will copy it with some slight variations — but nothing is going to be ridiculous," he said after the hearing.

If enough states pass airline passenger rights laws, the federal government would probably create its own version, which would provide the uniform set of rules the airlines want, Hudson said.

In response to questions from U.S. District Court Judge Lawrence Kahn, the Air Transport Association's Span acknowledged that there are currently no federal rules governing services airlines provide during ground delays. He said the federal Transportation Department is considering establishing some.

After the hearing, Span said many airlines — including JetBlue, whose delays after grounding more than a thousand flights during a Valentine's Day ice storm last year were the main impetus behind New York's law — have established their own policies to provide better service to delayed passengers.

Charles Fuschillo Jr., a Long Island Republican who sponsored the legislation in the state Senate, said the law passed only after the airlines proved that they weren't doing any better and were unresponsive to state lawmakers' concerns.

"The airline industry said, 'We can do this,' but I made it very clear to them that they had failed to provide consumers with basic necessities," Fuschillo said.

The airline industry has asked Kahn for a summary judgment in the case — meaning he would decide based on legal arguments without a jury trial — and to block the law from taking effect on Jan. 1.

The judge said he plans to make a decision within a week.

    You may already know that we have been giving Google Premium Placements to users who maintain a RepScore Level of 5 or better. Now on the about RepScore page, we provide a table of Levels, Points, and Perks. Later this week RepScore Perks will change to the following:

Spend a few minutes in the next day or two to boost your RepScore Level to 9 or 10 to earn these great Perks. Of course our Premium Subscribers get these features and more regardless of RepScore Level.

  2. Contact Networking

    Invite your Contacts to connect with you on Naymz and we’ll:

    • Keep you posted on their latest profile and web activity.
    • Allow them to leave comments on your profile.
    • Allow you to quickly broadcast job opportunities or questions to your network.

    Your contact network is private except that visitors to your profile can see which contacts they have in common with you. Naymz has an Open Networking model. Any Naymz user can invite you to be a Contact directly from your profile. If you receive invitations or messages that appear to be SPAM, please mark the message as SPAM in your inbox. Spammers will be penalized and may have their profiles removed.

Think your online past can’t come back to haunt you? Think again. Per TechDirt (hat tip to John Battelle), “Judges Say Google Background Checks Are Okay.”

“One federal employee who got fired for misusing government property alleged that a Google search by an official as part of the investigation into his thefts violated his “right to fundamental fairness”. A three-judge panel disagreed, rejecting the claim that the search, which turned up information about two previous times the guy had been removed from a job, affected the decision to fire him.”

Yes, your employers are using search engines to dig up digital dirt on their employees. And apparently this is a-ok to do according to a Federal Court. Don’t you think it’s time to control your online identity?

Getting Vertical - People Search

Our comrade over at ClaimID, Fred Stutzman, posted a great POV piece in regards to the recent media coverage people search has received this week.

Search is undoubtedly becoming vertical, and has been moving in that direction over the past few years. There have long been shopping vertical sites. MySimon, NexTag, and the now defunct Froogle (now named Google Products) come to mind. The travel industry set the standard for vertical search with sites like SideStep, Mobissimo, FareChase (now owned by Yahoo) and Kayak. During my tenure at Orbitz, I became very familiar with the products as I managed the relationships between these engines and the inclusion of Orbitz inventory in them. The next wave of vertical search sites came in the form of job search engines like Indeed.com and SimplyHired.

Google and Yahoo are no strangers to “verticalization”. Blog search, image search, video search, news search. Google is even testing a new layout where these options are extremely integrated with the search results page. There is also the practice of “vertical creep”. Type in “Chicago to New York” in Google and you will see what I mean.

And let’s not forget about Google Base, the big G’s attempt to make everything from recipes to cars vertical. It has SO much potential to revolutionize seach and put a lot of meta-search type companies out of business. However, Google has yet to really build those products out and has not gotten much traction in terms of usage.

So, here comes people search. It’s nothing entirely new as sites like ZoomInfo have been at it for some time in terms of attempting to organize public professional data and make them findable. However, the evolution of social media has opened up a huge, gaping hole. More and more people are using sites like MySpace, Facebook, YouTube, and blogs to define and promote their individuality. In its current state, this data is incredibly fragmented and poorly organized. There are a number of companies like us who are all taking unique approaches in trying to solve the problem of making identity search easy, accurate, fun, and last-but-not-least self-sustaining as a business model. It’s no small feat.

We are so excited to be a part of this evolving online identity space. We are not quite sure exactly where it’s going to go, but look forward to the ride and plan on doing our best to influence the outcome by improving the model. We have some things planned this year that should continue to move us in the right direction and we hope change the game. Stay tuned.

MySpace Strikes Again – College Student Denied Degree

According to CNN, a Millersville University female was taken away a right to a teaching degree because of a photo found on her MySpace page.

I usually don’t side with students who don’t use their heads when posting to social networking sites, but this ruling is a little harsh considering the content.

“The photo, taken at a 2005 Halloween party, shows Snyder wearing a pirate hat while drinking from a plastic “Mr. Goodbar” cup. It was posted on her own MySpace site.”

The student has filed a lawsuit against the school. Here are some more juicy tidbits over at the Smoking Gun.

Regardless of the outcome, this shows you can never be too careful about what you and others place on the transparent world of MySpace and other social media outlets.

Howard Wolinsky of the Sun-Times ran a great piece yesterday about the emergence of Web 2.0 companies here in our own backyard, sweet home Chicago. Thanks to Howard for including us in his story. There are some great ideas brewing here, and we are all looking to continue to blaze the trail that home grown online companies like Orbitz, FeedBurner, 37Signals, and others have set forth for us.

With our recent bid for the 2016 Summer Olympics, Hollywood’s new found love for filming in Chicago, the Baby Bulls sweep of the Miami Heat, and all these great internet start-ups, Chicago is the place to be!

Speaking of Orbitz, it’s good to see a few Orbitz alum involved in the start-ups featured here like our friend Blagica Stefanovski at CondoPerks.com and Leon Chism, Kevin Lilly, Andy Ayers, and Kyle Bolstad (thanks for the update, Kevin!) at Viewpoints.com.

You can customize what you want to show in your recent web activity as well as how many results you want to appear.











Subscribe and Bookmark

If you have your “recent web activity” activated on your page, your friends and colleagues can now subscribe to your feed to keep up with what’s happening in your world. We also added a bookmark button in case anybody wants to add your profile page to their favorites.

If a Tree Falls in the Woods…

Let me blow the dust off this thing! Yes, our blog has been dormant for, well, just about the entire year so far. We broke the number one cardinal rule for blogging, “don’t stop blogging”. I know we worked to gain a few subscribers and regular readers over the last half of 2006. I assume just about all of you have deleted our feed or removed us from your bookmarks. I can hear the echoes in here already.

We are proud of what we have achieved in the first 10 months since we launched. We have received lots of positive feedback, thousands of sign-ups, some really great media coverage, some really awesome letters of appreciation from users who have gotten great use from Naymz. It’s been such a neat experience for all of us and the light at the end of the tunnel gets a little brighter every day. This online identity space is getting more attention each day and we are glad to be a part of it.

We have actually rolled out some pretty cool features since I last posted an update, and we have lots more brewing. I’ll send a recap of those new features later today.

For those of you reading this, thanks for sticking around. For those of you who gave up, we’ll do our best to earn back that slot in your feedreader.
